Question about assault

My dad told me that if someone attacks you and you hit them with a Maglight, and it puts them in hospital or whatever, the poilce can't charge you with assault. Is this true?

From what I know you can't excessively defend yourself. Like if someone hits you once, you can't beat them unconscious. Well, unless you knock them out with one or two hits.

In my state, if someone attacks you, you can kill him if you think that's what you need to do.

But we're barbaric, so that's not the common code.

Southern states are assbackwards to hell. In my state, I can shoot you if you step on my private property (frontlawn, backyard, anywhere basically).

In Germany if someone tries to rob you in your house and you beat him up he can sue you. :|
 
I actually don't disagree with some of the American laws when it comes to home defence. To me shooting an intruder is self-defence, excessive maybe, but if I was home with my spouse or little niece and some crack-head or pervert broke-in I'd have no problem putting lead between his eyes. Unfortunatly in Canada, that'd be murder :nape:

I keep a canister of pepper-spray in my end table drawer just in case. Actually its bear repellent since self-defence pepper spray is illegal for the public to own in Canada....although, bear and dog repellent isn't (even though it's basically extra-strength mace), go figure...

I agree with the breaking in law, if someone breaks in and is a threat to your livlihood and family, you should be able to f*ck him up.

I remember reading this story in the paper like 10 years ago when some guy was breaking into a house through a window and slipped and fell on some jagged glass. He ends up getting injured fairly seriously and actually sues the homeowners and won. There was public outcry and people demended that some laws be changed, but I think it was eventually swept under the rug..

yea, i remember this story being mentioned in the Movie "Liar, Liar" starring Jim Carey.
