YELLOW CARD: Untrustworthy
Alright guys were to start.. Here's is something that happened over the weekend that has left me in a state of amazement.

If you guys remember a few months ago my ordeal with a small accident with my car - a 05 Nissan Sentra SE-R . Well over the weekend my brother decided to take it for a spin, the next day I get a call, "he is in the hospital.. car accident". At the moment I am worried, not only for my brother but for the car. The day passes and I'm told my brother is fine, just a broken arm that needed to be operated on. His friend -the passenger-, a broken leg.

WHat happened?? He was driving through some mountains, loss control in a tight turn, goes over the cliff.... 200+feet fall. After seeing the car, it is a complete wreck but even more amazing is the fact that both were able to walk away from the accident. Also worth mentioning is that my brothers airbag didn't deployed but the steering wheel is folded in half.

The car may be lost but my brother is well and recovering.. surely a story worth placing in the "I shouldn't be Alive" category.

The story is way too odd to be true but I have seen such acciddents happenning and the passengers being taken away safe and sound.

But yes,your brother is really a very lucky person.

Dude, you need to avoid a lawsuit. From what I've looked up in the last 5 minutes you could be seriously ****ed because California uses a "pure negligence" threshold for lawsuits. That means that since you can be found responsible (through your negligence) for SOME part of the damages because the airbag didn't deploy and you should have known about it being defective at the time (that's what the opposing lawyer will argue).

As far as I know California only requires that a jury find you negligent to some standard, like if you are negligent and it causes 10% of the damages, you're ****ed even if the guy suing you is 46% negligent. You're still gonna owe that mother****er 10% of the damages that he lost because of the car accident. That **** isn't fair, but it's probably going to happen unless you can prove that a reasonable person couldn't have known that the airbag was defective.

Seriously man, if there is any kind of civil action brought against you trying to seek recovery because of your negligence, hire an attorney immediately. You will probably be okay, but if you get named in a lawsuit, get counsel as quick as possible. You'll probably win, but it might require a trial.
