Problem with Game

I got Battlefield 2: Modern Combat for the Xbox. I started playing it and it kept saying that the disk was dirty. It was a brand new game, so after I played once I checked the disk and it was scratched up. The next day I tried playing again and it didnt work. It said that the disk was dirty or damaged. I checked the disk and it had scratches all over it. Is it my Xbox scratching the disk, or whats going on here?

well, it could be it got scratched in the store or where it was made, i had THAT problem too once.

ya but it has happened twice already with 2 completely different disks. I have to return it tomorrow anyways so ill c whats wrong with it.
