btw. what interesting Linux is free, but you can sell it too without crediting authors...you can download KDE, Mandrake, Red Hat etc. but you can buy it on CD/DVD too and it's legal

well its not a good think what this guy is doing, but maybe the people who buy it dont have a broadband connection and find it better to buy the patch. In this way even those people can enjoy the patch.
I dont think hes making an awfull lot of money out of it, minding he has also pay for the cds and sending costs.
Maybe Wolf should sell the patches himself on ebay to prevent this.

Yeah wolf, there is a market for ppl without broadband, maybe u shud tap it. frankly i wouldnt mind paying a small fee for patches. perhaps £1.99 or something. would only be a cd and postage of. plus take donations.

This is exactly what he can't do, as the patch contains copyrighted content already - i.e all the kits, logos etc. not officially licensed for use in the game. You can't copyright what's already been copyrighted. Technically, the patch is illegal in the first place, but of course no action would ever be taken against Wolf or any other PES fan for creating these patches. However, selling it for profit is much worse, but it's not something that Wolf or anyone else can do anything about. It would be up to the companies whose unlicensed content is being used in the patch to take action against this guy who is making money from it. It's up to Ebay what action they take, but we shall see what happens...

I think most of the contents of the patch (FIFA logos etc.) are copyrighted but only if you use the commercially. You are allowed to use them for non-profit use so that would make such a patch legal, it's a bit of a grey area.
However when someone takes the patch and makes money off it then that's defenitely illegal!

In your next patch put a message on the title screen and in the readme which states something along the lines of:
"This patch is a free download from http:/xxxxx. It is strictly forbidden to sell or exchange this patch for cash. If you have purchased this patch please return it immediately and report the seller to [email protected]"

Now I know this is in no way gonna stop some1 that really wants to do what this guy is doing, but it might make em think twice. I can't imagine the guy selling it would be clever enough to re-edit the message out of the title screen.

It's precisely because it's a non-profit venture that no legal action would ever be taken (touch wood), but a company like Nike for example would be perfectly within their rights to demand the Nike Aerow balls be removed from the patch. They would of course ask politely, but if Wolf refused they could take legal action if they wanted to. Truth is though, even if they heard about what this guy was doing on Ebay they probably wouldn't do much about it - they may politely ask him to remove the auction, but he's made his money now so that's hardly going to hurt him. And in the grand scheme of things, what he's made is nothing to these huge global companies, so they are hardly going to be after a slice of his action.

Its free advertising for Nike and all the other companies involved hence they wouldnt waste they time with a copyright lawsuit.

IMO the best thing to do is just post a link of the free thing and that way people will not waste their money for something they can get for free.

To turn this topic around slightly - is there anywhere that I can buy a 'legal' CDROM with newest wolf patch on it?

I have a bandwidth cap on my connection, and won't be able to use the Internet for a month if I download the whole thing!

I am quite willing to pay a couple of quid to cover the price of the disc and the postage, and the time taken to do it.

Obviously, I'd rather buy it from someone properly and fairly than from some freeloader on ebay.

Any ideas?

i gave the seller a little bit of the old guilt trip treatment - he's replied by saying : i am removing it from ebay, sorry for the offence caused. - at least he's admited the error of his ways

Hey Wolf!
Do you have an e-bay account?
Create a product for sale with a simillar name and say it's for free or for as less as you can.
Than, as a description, say that you do not sell illegal copies of the game but that the patch is available, for free, at FileFront. ;)
