I don´t know about the english laws, but i guess that the CE laws are the same for all the European Community. So, we can continue editing, due we are not incurring in any fault, due that we are like a third person. Is a bit difficult to explain, let´s see.
Konami provide us a game that we use like a tool for recreate real players, logos, etc....in this case of the FA, so we are not doing anything bad, in all the cases the fault could be of the programers (Konami) that provide us of the game as a "TOOL" giving us the chance of editing any aspect of their game. We are acting like a third person, so is not our fault if we are editing any aspect of the game, due that we are not the creators of PES5.
The "extra" tools that we are using are of OUR property, or property of any programer (oedit, dkz, graphic studio, etc...) and this "extra" tools are not only made for edit the FA indeed, are using for edit games, and PES5 with other games, are included on this list. Third person again. This aspect is very important due that we are not the FIRST person (Konami) that made the first step.
Following the laws, the FA could demand Konami but not to us. Thing that will be very sad and patetic for its part.
In any case the FA cannot incour in law actions against us, overall because this is a FORUM, not a company,,,, so under the European laws, this point is impossible that have success. And more, as Hrvoje saids, we are not selling anything, and this is not a fault. This point is important too.
So the background is clear. Mr. Money, as always, they sure want to take part of each thing that we can create, anyway this aspect is easy to put well. Once you made something with relation with the FA, put on the credits that "The logos, etc, etc,,,used in this pacth are property or trademark of, etc,etc,," that´s the legal point and they cannot do anything on this point.
They cannot continue with this fool thing, if they are clever, they will be think in all the TITANIC enfort that must to do for incurring in legal actions against each community member (thousands, and thousands), besides the fact of that each country has its own laws. Will be they able to demand extraditions of people outside Europe??, like Africa, the States, or South America???? pffffff.....i think that not....is a thing that will cost millions and millions of euros and they will not do, more, they can´t do for all the legal explainment that i putted at the beggining.
So, i hope that this point will be clear for to put calm in the community, may be is a bit difficult to understand, but i hoped to have explain me well. Almost to have a few years studing laws have service now...pffff....
Anyway....Anyone have the link with it puts that the FA want to incour in legal actions on pacthing the game??
